SPECIAL MEETING
MONDAY, DECEMBER 3, 2007

Minutes
Present: Board members Asmus, Bruce, Carpenter, Carter, Chamberlin and Fleischer; Administrators Gersen and Williams; three members of the public; Recorded by Asmus.
1. Call to order – Chair Asmus called the meeting to order at approximately 2:20 p.m.
2. Discussion of Hearing Process – The Chair outlined the process to be followed in the hearing to appeal an administration decision regarding Policy JBB Entrance Age.
o Because of the privacy rights of the child and family involved, the hearing shall be held in non-public session. Consistent with NH Department of Education regulations, ED 204.1, the hearing shall be tape recorded.
o Those appealing the decision and the administration shall both be given an opportunity to make a presentation followed by questions. The board deliberation shall be held afterward with only the board present.
The Chair discussed a flow chart designed to help the board determine:
1. Whether due consideration/process had been given the initial request; and
2. Whether the administration’s decision could be considered arbitrary or capricious.
The Chair stressed that even if these two questions were answered satisfactorily, that it is within the board’s purview to consider a wide array of factors and, if it so choose, to overturn the administration’s decision.
This hearing process, as outlined, met with the general approval of those present.
3. Nonpublic Session – Chamberlin moved and Bruce seconded a motion to go into nonpublic session in accordance with RSA 91-A:3, II(c) for a hearing and discussion of matters of an individual. The motion passed unanimously by roll call vote of the board. The board entered nonpublic session at approximately 2:35 p.m.
4. Adjournment – Fleischer moved and Carter seconded a move to adjourn at approximately 6:18 p.m. The motion passed unanimously.
The meeting adjourned at approximately 6:18 p.m.
